INLEIDING

In juni anno Domini 2022 heeft ondergetekende aan Vervoerregio Amsterdam

de Eis gesteld, geen concessie te verlenen aan EBS voor het vervoer van

reizigers in Zaanstreek-Waterland.

Reden?

Omdat EBS als dochter van Egged Bus Systems [het  Besmette Hoofdbedrijf, dat 

opereert in de illegale Israelische nederzettingen], betrokken is bij

het Israelische bezettings en apartheidseconomie [1]

Na enkele weken [ook in juni] kreeg ik een reactie van Vervoerregio Amsterdam,

via de heer Trouw [Informatiebeheer] namens de Directie, waaruit bleek, dat ondanks mijn bezwaren en van anderen] de concessie TOCH aan EBS was verleend. [2]

Uiteraard heb ik dat er niet bij laten zitten en ben ik in de pen geklommen,

hetgeen heeft geresulteerd in een pittige tegenreactie, die ook

een waarschuwing voor de toekomst inluidt!

Op 6 juni 2022 heeft u een email gestuurd waarin u uw zorgen heeft geuit over de deelname van vervoerder EBS Public Transportation B.V. (‘EBS’) aan de aanbesteding van de concessie voor het openbaar vervoer in de regio Zaanstreek-Waterland. 

U stelt in uw email dat Egged, het moederbedrijf van EBS, zich schuldig maakt aan mensenrechtenschendingen door busvervoer te verzorgen in bezet Palestijns gebied, en EBS – als dochteronderneming van Egged – hier betrokkenheid bij heeft. U doet daarbij een dringend beroep op de Vervoerregio om EBS uit te sluiten van deze aanbesteding. 

We hebben zorgvuldig naar uw verzoek gekeken en zijn tot de conclusie gekomen dat wij niet aan uw verzoek kunnen voldoen.

 In deze brief lichten wij toe hoe wij tot deze conclusie zijn gekomen. 

De Vervoerregio kan een inschrijver van deelname aan een aanbesteding uitsluiten indien een of meerdere uitsluitingsgronden uit de Aanbestedingswet 2012 van toepassing zijn. 

De Vervoerregio heeft bij de aanbesteding van de concessie Zaanstreek-Waterland zowel de verplichte als facultatieve uitsluitingsgronden uit de Aanbestedingswet toegepast, waaronder de uitsluitingsgrond van artikel 2.87, eerst lid, onder c (‘ernstige fout in de uitoefening van zijn beroep’). 

De Vervoerregio heeft de inschrijvingen zorgvuldig getoetst aan deze uitsluitingingsgronden.

 Inschrijvers is gevraagd door middel van een Gedragsverklaring Aanbesteden aan te tonen dat de uitsluitingsgronden die betrekking hebben op de integriteit van ondernemers niet van toepassing zijn. In de door EBS overgelegde Gedragsverklaring Aanbesteden is door de Minister van Justitie en Veiligheid verklaard dat er geen bezwaren zijn tegen EBS in verband met deelname aan aanbestedingen.

Uit de rechtspraak volgt dat een inschrijver niet mag worden uitgesloten vanwege het feit dat een moedermaatschappij of een andere rechtspersoon binnen dezelfde groep een ernstige beroepsfout heeft begaan, waarbij de inschrijver zelf niet betrokken is geweest.1 

Kortom, er is geen grondslag voor uitsluiting van EBS op grond van artikel 2.87, eerste lid, onder c van de Aanbestedingswet 2012. 

De Vervoerregio heeft bij de beoordeling van de inschrijving van EBS geconstateerd dat geen van de uitsluitingsgronden op EBS van toepassing is, en heeft de inschrijving van EBS toegelaten tot de verdere beoordelingsprocedure. 

Op 23 juni 2022 heeft het dagelijks bestuur het bod van EBS als inschrijving met de beste prijs-kwaliteitverhouding aangemerkt en de concessie Zaanstreek-Waterland aan EBS verleend. Ik vertrouw erop u hiermee voldoende te hebben geïnformeerd.

Geachte heer De Vries

”Liever te laat dan nooit”, zegt een Oud Vaderlands Spreekwoord

Mijn late reactie wordt deels verklaard door mijn drukke tijdsschema

Want naast uw organisatie zit ik meer organisaties/bedrijven op

de huid, die via drogredenaties en/of uitvluchten trachten hun betrokkenheid

bij het onrecht in Palestina goed te praten, dan wel te bagatelliseren.

Als u dus, na mijn aanvankelijk schijnbaar zwijgen op uw antwoord

op mijn protestbrief aan u [1], dacht, van mij af te zijn, dan vergist u zich deerlijk.

Ook in de toekomst zal u van mij niet af zijn, bereidt u zich daar maar

alvast op voor:’

NIET WELLEVEND

Wellicht van ondergeschikt belang, maar toch niet zonder betekenis

Ten eerste, meneer de Vries, vind ik de wijze van beantwoording van

mijn protestbrief, waarin geformuleerd de u bekende eis, weinig

elegant en zelfs onwellevend:

Niet alleen neemt u niet eens de moeite, mij

persoonlijk te antwoorden en scheept u daar uw medewerker Informatiebeheer

mee op, daarnaast krijg ik uw reactie niet direct, maar via een PDF Bestand.

Ik vind dat een gebrek aan respect.

Tenslotte heb ik ook de moeite genomen, u langs de reguliere weg

aan te schrijven en een dergelijk direct antwoord verwacht ik van u ook.

Maar dat is nog het minst belangrijk

Nu naar de Hoofdzaken

VERVOERREGIO AMSTERDAM, MEDEPLICHTIG AAN ERNSTIGE

MENSENRECHTENSCHENDINGEN

Het meest schandelijke vind ik het feit, dat u, ondanks door mij

en anderen terecht geuite bezwaren [2] het toch hebt bestaan,

de concessie Zaanstreek-Waterland te gunnen aan een besmet

bedrijf als EBS.

Ik citeer uit uw Brief/PDF Bestand aan mij

”Op 23 juni 2022 heeft het dagelijks bestuur het bod van EBS als inschrijving met de beste prijs-kwaliteitverhouding aangemerkt en de concessie Zaanstreek-Waterland aan EBS verleend.” [3]

U moet zich schamen en bent hiermee voor mij en anderen moreel

willens en wetens medeplichtig aan de door Moederbedrijf Egged 

gepleegde mensenrechtenschendingen in bezet Palestijns gebied. [4]

Want komt u bij mij niet aanzetten met bagatelliseringen als

artikel 2.87 uit de Aanbestedingswet, onder andere luidende

”De aanbestedende dienst kan een inschrijver of gegadigde uitsluiten van deelneming aan een overheidsopdracht of een aanbestedingsprocedure op de volgende gronden:

…..

”de inschrijver of gegadigde heeft in de uitoefening van zijn beroep een ernstige fout begaan die door de aanbestedende dienst aannemelijk kan worden gemaakt; [5]

Met dergelijke flutargumenten tracht u mijn bezwaren en van anderen

te ridiculariseren, want het gaat hier niet om een ”ernstige fout”, die

EBS gemaakt zou hebben.WAS dat maar zo, zou ik willen zeggen:Het gaat hier om de onderdrukking van de bezette Palestijnse bevolking,die niet alleen onrechtmatig wordt bezet door Israel, maar ookdagelijks wordt geterroriseerd door kolonisten, bewoners dusvan de illegale nederzettingen [6], waar het moederbedrijf van EBS, Egged haar busonderneming heeft!Het enkele feit, dat EBS de dochter van Egged is en dus volgens uwredenaties niet rechtstreeks verantwoordelijk, is slechts het Spelenmet Woorden.EBS is ONDERDEEL van Egged, kan daarvan niet worden losgezienen is dus wel degelijk betrokken bij de misdaden van Egged.Want uw bagatelliserende opmerking als zou Egged een”ernstige beroepsfout” hebben begaan [7] is, vergeef mij hetwoord, natuurlijk flauwekul.Het faciliteren van diensten aan een bezettingsstaat, die Israel is,het faciliteren van Diensten in bezet gebied, waar de bezette Palestijnsebevolking dagelijks slachtoffer is van apartheid [8] en ernstige terreur [9]is een misdaad.
Een MISDAAD, meneer de Secretaris Directeur, geen ”Beroepsfout” [10]Laat dat maar eens goed tot u doordringen!!!
TENSLOTTE”
Dat u, ondanks mijn zeer valide bezwaren en die van anderen [11], dat het niet aangaat, zaken te doen met de niet van het Moederbedrijf losstaandebedrijf EBS, dat [door het Moederbedrijf Egged] is verbonden methet zaken doen met een bezettings en apartheidsregime [12], toch kiedstvoor de samenwerking met EBS en het Lef heeft, dat in een briefaan mij te vermelden, alsof dat de gewoonste zaak van de wereld is [13],laat uw morele failliet zien.Dat u zich daarbij beroept op allerlei formele regeltjes[natuurlijk zal een bedrijf als EBS de zaak naar de vorm laten kloppen,dat doen Schurken wel vaker] ontslaat u niet van uw verantwoordelijkheid en medeplichtigheid aan Apartheid. [14]
Daar mag u het mee doen.
Denk overigens niet, dat dit het laatste protest was tegen uwpraktijken,Ook in de toekomst zullen ik en anderen paraat blijven.

Binnenkort wordt besloten welk bedrijf het busvervoer in de regio Zaanstreek Waterland mag gaan verzorgen. EBS is één van de bedrijven die meedingen naar deze concessie.

Wat kun je als consument doen om te voorkomen dat jij als OV-reiziger straks moet meebetalen aan mensenrechtenschendingen?

Schrijf een email naar de leden Provinciale Staten van de provincies …. naar de portefeuillehouders OV Gedeputeerde Staten en naar het bedrijf dat belast is met het beoordelen van de inschrijvingen voor de concessie in Zaanstreek Waterland. Laat hen weten dat EBS moet worden uitgesloten van deze concessie en van alle toekomstige concessies, tot het bedrijf zijn leven aantoonbaar heeft gebeterd.”

EBS BUSSEN: ONBEWUST MEELIFTEN MET APARTHEID

Er zijn kortom genoeg redenen om EBS uit te sluiten van aanbestedingen in het Nederlandse busvervoer. Bovendien, door concessies aan EBS te gunnen worden reizigers die op het openbaar vervoer zijn aangewezen gedwongen aan boord te gaan bij een bedrijf dat betrokken is bij illegale activiteiten, mensenrechtenschendingen en mogelijke oorlogsmisdaden in bezet Palestina. Reizigers beseffen veelal niet dat hun euro’s indirect ten goede kunnen komen aan mensenrechtenschendingen. Dat zou ook niet hoeven: het publiek moet erop kunnen vertrouwen dat het mensenrechtenbeleid bij de overheid in veilige handen is.

Kom in actie!

Binnenkort wordt besloten welk bedrijf het busvervoer in de regio Zaanstreek Waterland mag gaan verzorgen. EBS is één van de bedrijven die meedingen naar deze concessie.

Wat kun je als consument doen om te voorkomen dat jij als OV-reiziger straks moet meebetalen aan mensenrechtenschendingen?

Schrijf een email naar de leden Provinciale Staten van de provincies …. naar de portefeuillehouders OV Gedeputeerde Staten en naar het bedrijf dat belast is met het beoordelen van de inschrijvingen voor de concessie in Zaanstreek Waterland. Until 2017, the parent company operated bus lines to Israeli settlements in the occupied West bank and Jerusalem. The bus lines were armored vehicles, that according to the company allowed them to pass through “Arab populated areas”. Since then, the operation of bus lines to settlements was transferred to the company’s subsidiary Egged Taavura. Egged Taavura operates bus lines to settlements in the West Bank, in the areas of Gush Etzion, Giva’at Ze’ev, Binyamin, Mount Hebron and Kiryat Arba, including settlements in the Jordan Valley, and the settlements of Shiloh, Otniel and Ma’ale Adumim.

The company’s subsidiary, Egged Heseim, Tours and Recreation, provides tours and travel packages to the Old City of Jerusalem and the City of David settler complex, located in the Palestinian neighborhood of Silwan in occupied East Jerusalem. The company also organizes tours to Bethlehem, Jericho and the occupied Syrian Golan,

In 2018, the company’s branch in Ashdod organized a donation campaign for the Israeli army in the area surrounding the besieged Gaza.

In November 2014, 27 Palestinian bus drivers at Egged quit their jobs and dozens more went on strike for fear of being attacked by Israeli settlers as tensions increased in Jerusalem during that period. This act came after driver Yusuf Hassan al-Ramouni was found hanged in an Egged bus in Jerusalem.

Presently, the company uses vehicles manufactured by Mercedes and Volvo.

The company is currently running for the tender to operate the new light rail line in Jerusalem, which will connect more settlements. The company was initially disqualified for fear of creating a monopoly (as it also operates buses in Jerusalem), but in March 2019 the general director of the Israeli antitrust authority ruled that it can, provided it commits to dropping some of its bus lines if selected.

Afdeling 2.3.5. Uitsluiting, geschiktheid en selectie

§ 2.3.5.1. Uitsluitingsgronden

Artikel 2.87

1.

De aanbestedende dienst kan een inschrijver of gegadigde uitsluiten van deelneming aan een overheidsopdracht of een aanbestedingsprocedure op de volgende gronden:

a. de inschrijver of gegadigdeverkeert in staat van faillissement of liquidatie, diens werkzaamheden zijn gestaakt, jegens hem geldt een surseance van betaling of een (faillissements-)akkoord, of de gegadigde of inschrijver verkeert in een andere vergelijkbare toestand ingevolge een soortgelijke procedure die voorkomt in de op hem van toepassing zijnde wet- of regelgeving;

b. jegens de gegadigde of inschrijver is een onherroepelijk geworden rechterlijke uitspraak gedaan op grond van de op hem van toepassing zijnde wet- en regelgeving wegens overtreding van een voor hem relevante beroepsgedragsregel;

c. de inschrijver of gegadigde heeft in de uitoefening van zijn beroep een ernstige fout begaan die door de aanbestedende dienst aannemelijk kan worden gemaakt;

d. de inschrijver of gegadigde heeft niet voldaan aan verplichtingen op grond van op hem van toepassing zijnde wettelijke bepalingen met betrekking tot betaling van sociale zekerheidspremies of belastingen;

e. de gegadigde of inschrijver heeft zich in ernstige mate schuldig gemaakt aan valse verklaringen bij het verstrekken van inlichtingen die door een aanbestedende dienst van hem waren verlangd of hij heeft die inlichtingen niet verstrekt.

De aanbestedende dienst betrekt bij de toepassing van het eerste lid, onderdeel b, uitsluitend onherroepelijke uitspraken die in de vier jaar voorafgaand aan het tijdstip van het indienen van het verzoek tot deelneming of de inschrijving onherroepelijk zijn geworden en bij de toepassing van het eerste lid, onderdeel c, uitsluitend ernstige fouten die zich in de vier jaar voorafgaand aan het genoemde tijdstip hebben voorgedaan.”

ISRAELI APARTHEID: ”A TRESHOLD CROSSED”

In April, Human Rights Watch released a 213-page report, “A Threshold Crossed,” finding that Israeli authorities are committing the crimes against humanity of apartheid and persecution. We reached this determination based on our documentation of an overarching government policy to maintain the domination by Jewish Israelis over Palestinians coupled with grave abuses committed against Palestinians living in the occupied territory, including East Jerusalem

In the months since, a growing chorus of voices, from former Israeli ambassadors to South Africa and current Knesset members to the ex-UN Secretary General and the French foreign minister, have referenced apartheid in relation to Israel’s discriminatory treatment of Palestinians, in particular in the occupied territory. Yet many in Germany, including those critical of Israeli human rights abuses, remain hesitant to apply the label to Israeli conduct.

Given history, one can certainly understand Germany’s concern for the welfare of the Jewish people, but that should not carry over to an endorsement of abusive and discriminatory Israeli government conduct, especially in the occupied territory. As recognition grows that these crimes are being committed, the failure to recognize that reality requires burying your head deeper and deeper into the sand.

The problem begins with the Israeli government having exercised primary control for more than a half-century over the land between the Mediterranean Sea and Jordan River, encompassing Israel and the occupied territory, where two main groups of people of roughly equal size live. Throughout this area, Israeli authorities methodologically privilege one of the groups, Jewish Israelis, who are governed under the same body of laws with the same rights and privileges wherever they live. At the same time, authorities allocate different baskets of inferior rights to the other, Palestinians, systematically discriminating against them wherever they live and most severely in the occupied territory.

Our sense that our research was not capturing this underlying reality led us to write this report. Reporting on “separate, not equal” schools for Palestinians inside Israel, Palestinians being forced out of their homes in occupied East Jerusalem, the serious rights abuses stemming from the Israeli settlement enterprise in the West Bank, and the crushing closure of the Gaza Strip, we felt that our work captured important dynamics, including entrenched discrimination, in particular areas, but did not capture the full scope of Israel’s discriminatory rule over Palestinians.

We set out in the report to evaluate Israel’s treatment of Palestinians across Israel and the occupied territory. As we do in the nearly 100 countries across the world we work in, we began by documenting the facts—drawing on years of our own research, case studies that compared Palestinian areas with predominantly or exclusively Jewish ones, and a review of government planning documents, statements by officials, and a range of other materials.

Across Israel and the occupied territory, Human Rights Watch found that Israeli authorities have pursued an intent to privilege Jewish Israelis at the expense of Palestinians. They have done so by undertaking policies aimed at mitigating what they openly describe as the “demographic threat” Palestinians pose and maximizing the land available for Jewish communities, while concentrating most Palestinian in dense enclaves. The policy takes different forms and is pursued in a particularly severe form in the occupied territory. It includes efforts to, as leading Israelis officials have put it, “Judaize” the Negev and Galilee regions of Israel and to maintain “a solid Jewish majority,” as described in government planning documents, in the Jerusalem municipality, which includes the eastern part of Jerusalem, which Israel unilaterally annexed and occupies. It also encompasses efforts to “settle [Jews in] the land between the [Palestinian] minority population centers and their surroundings” in the West Bank, as set out in plans that have guided the government’s settlement, and to pursue “separation” between the West Bank and Gaza. The policy across the board serves the same fundamental goal: maximum land, minimum Palestinians. 

Furthermore, we found that Israeli authorities have carried out the grave abuses needed for the crimes of apartheid and persecution against Palestinians living in the occupied territory. It has done so through, among other policies, sweeping restrictions on movement in the form of the 14-year generalized closure of Gaza and the discriminatory permit system in the West Bank; the confiscation of more than a third of the land in the West Bank; and denial of residency rights to hundreds of thousands of Palestinians and their relatives. Israel has imposed draconian military rule over millions of Palestinians, suspending their basic civil rights, while Jewish Israelis living in the same territory are governed under the permissive Israeli civil law; and imposed harsh conditions in parts of the West Bank that led to forcing thousands of Palestinians out of their homes.

We then evaluated these facts against the relevant areas of international law—in this case, the established law on discrimination—which includes a universal prohibition against apartheid. While the term was coined in relation to specific practices in South Africa, international treaties define apartheid as a universal legal term referring to a particularly severe form of discriminatory oppression.

International criminal law, including the 1973 International Convention on the Suppression and Punishment of the Crime of Apartheid and the 1998 Rome Statute to the International Criminal Court, define apartheid as a crime against humanity consisting of three primary elements: (1) an intent by one racial group to dominate another; (2) systematic oppression by the dominant group over the marginalized group; and (3) particularly grave abuses known as inhumane acts.

Racial group is understood today also to encompass treatment on the basis of descent and national or ethnic origin. International criminal law also identifies a related crime against humanity of persecution. Under the Rome Statute and customary international law, persecution consists of severe deprivation of fundamental rights of a racial, ethnic, or other group with discriminatory intent.

The ratification by the State of Palestine of these two treaties in recent years has strengthened the legal application of these two crimes in its territory. A ruling by a chamber of the International Criminal Court (ICC) earlier this year confirmed that it has jurisdiction over war crimes and crimes against humanity – including apartheid and persecution – committed in the Occupied Palestinian Territory since 2014.

Applying the facts to the laws, Human Rights Watch concluded that Israeli authorities are committing the crimes against humanity of apartheid and persecution. We found that the elements of the crimes come together in the occupied territory as part of a single Israeli government policy. That policy is to maintain the domination by Jewish Israelis over Palestinians across Israel and the occupied territory. It is coupled in the occupied territory with systematic oppression and inhumane acts against Palestinians living there.

Sometimes the most important thing someone who cares deeply about you can do is to share hard truths and push you to confront them. The late Israeli Prime Minister Yitzhak Rabin and leaders of Israel’s closest ally, the US, including former President Jimmy Carter and former Secretary of State John Kerry, warned of the prospect of apartheid if things did not change.

Today, apartheid is not a hypothetical or future scenario. A 54-year-occupation is not temporary. The threshold has been crossed. Apartheid, and parallel persecution, is the reality for millions of Palestinians. Recognizing and correctly diagnosing a problem is the first step to solving it and ending apartheid is vital to the future of both Palestinians and Israelis and the cause of peace. It is by extension Germany’s special relationship with Israel and history that should prompt them to recognize the reality of apartheid and persecution and bring to bear the sorts of tools needed to end these crimes against humanity.

Op 6 juni 2022 heeft u een email gestuurd waarin u uw zorgen heeft geuit over de deelname van vervoerder EBS Public Transportation B.V. (‘EBS’) aan de aanbesteding van de concessie voor het openbaar vervoer in de regio Zaanstreek-Waterland. 

U stelt in uw email dat Egged, het moederbedrijf van EBS, zich schuldig maakt aan mensenrechtenschendingen door busvervoer te verzorgen in bezet Palestijns gebied, en EBS – als dochteronderneming van Egged – hier betrokkenheid bij heeft. U doet daarbij een dringend beroep op de Vervoerregio om EBS uit te sluiten van deze aanbesteding. 

We hebben zorgvuldig naar uw verzoek gekeken en zijn tot de conclusie gekomen dat wij niet aan uw verzoek kunnen voldoen.

 In deze brief lichten wij toe hoe wij tot deze conclusie zijn gekomen. 

De Vervoerregio kan een inschrijver van deelname aan een aanbesteding uitsluiten indien een of meerdere uitsluitingsgronden uit de Aanbestedingswet 2012 van toepassing zijn. 

De Vervoerregio heeft bij de aanbesteding van de concessie Zaanstreek-Waterland zowel de verplichte als facultatieve uitsluitingsgronden uit de Aanbestedingswet toegepast, waaronder de uitsluitingsgrond van artikel 2.87, eerst lid, onder c (‘ernstige fout in de uitoefening van zijn beroep’). 

De Vervoerregio heeft de inschrijvingen zorgvuldig getoetst aan deze uitsluitingingsgronden.

 Inschrijvers is gevraagd door middel van een Gedragsverklaring Aanbesteden aan te tonen dat de uitsluitingsgronden die betrekking hebben op de integriteit van ondernemers niet van toepassing zijn. In de door EBS overgelegde Gedragsverklaring Aanbesteden is door de Minister van Justitie en Veiligheid verklaard dat er geen bezwaren zijn tegen EBS in verband met deelname aan aanbestedingen.

Uit de rechtspraak volgt dat een inschrijver niet mag worden uitgesloten vanwege het feit dat een moedermaatschappij of een andere rechtspersoon binnen dezelfde groep een ernstige beroepsfout heeft begaan, waarbij de inschrijver zelf niet betrokken is geweest.1 

Kortom, er is geen grondslag voor uitsluiting van EBS op grond van artikel 2.87, eerste lid, onder c van de Aanbestedingswet 2012. 

De Vervoerregio heeft bij de beoordeling van de inschrijving van EBS geconstateerd dat geen van de uitsluitingsgronden op EBS van toepassing is, en heeft de inschrijving van EBS toegelaten tot de verdere beoordelingsprocedure. 

Op 23 juni 2022 heeft het dagelijks bestuur het bod van EBS als inschrijving met de beste prijs-kwaliteitverhouding aangemerkt en de concessie Zaanstreek-Waterland aan EBS verleend. Ik vertrouw erop u hiermee voldoende te hebben geïnformeerd.

Geachte mevrouw Smit,

Uit betrouwbare bron heb ik vernomen, dat uw organisatie eventueel

voornemens is, de verzorging van het OV vervoer

in de regio Zaanstreek-Waterland te gunnen aan busbedrijf EBS 

[Egged Bus Systems] [1]

Hierbij een dringend beroep op u NIET met dit door en door foute

bedrijf in zee te gaan!

WAAROM FOUT BEDRIJF?

Dit bedrijf, EBS, is dochter van het Israelische Bedrijf Egged Group,

dat betrokken is bij de illegale Israelische nederzettingen! [2],

waardoor dit bedrijf op de VN Zwarte Lijst is komen te staan.

Gelooft u mij niet?

BEZETTING EN NEDERZETTINGEN

Ik ga ervan uit, u niet meer te hoeven in te lichten over de foute, illegale

Israelische bezetting van de Palestijnse gebieden de Westelijke Jordaanoever,

Oost-Jeruzalem en Gaza [4] en de daaraan gekoppelde onderdrukking en 

gepleegde oorlogsmisdaden, met name tijdens de invallen in Gaza [5].

Maar er is, zoals u behoort te weten [want daar gaat deze Brief over] meer.

Want niet alleen oefent Israel een bezettingsterreur uit en wordt

door de mensenrechtenorganisaties Amnesty International en Human

Rights Watch terecht beschouwd als een Apartheidsstaat [6], Israel houdt

zich ook onledig met een ander Groot Kwaad:

De in bezet gebied gebouwde en zich immer uitbreidende nederzettingen,

wat neerkomt op platte landroof en die illegaal zijn volgens het

Internationaal Recht! [7]

Dat weet u of althans:

Dat hoort u te weten.

Dan heb ik het nog niet eens gehad over de dagelijkse terreur,

die door de kolonisten [bewoners van die nederzettingen] wordt uitgeoefend

tegen de bezette Palestijnse bevolking, een terreur, die zijn steun vindt

in de Israelische Bezettingsstaat! [8]

Moet ik meer toevoegen?

Ik denk het niet

EPILOOG

Ik heb u de feiten gegeven

Zowel over de misdaden van Bezettingsstaat Israel als 

het feit, dat dit specifieke Bedrijf werkzaam is in

de illegale nederzettingen, ontstaan door geweld tegen en

landroof op de bezette Palestijnse bevolking, een Bedrijf dat,

zoals ik in bovenstaande genoemd heb, bovendien op

de VN Zwarte Lijst staat. [9]

Feitelijk is het al een schande voor u, dat ik [en vele anderen, naar ik hoop]

u deze informatie moesten aandragen

Uit uzelf had u al op de hoogte moeten zijn en niet eens de samenwerking

met een dergelijk Gangsterbedrijf moeten overwegen!

Maar nu kent u de feiten en kunt u er NIET meer omheen!

Een dringende oproep dus om de verzorging van het OV vervoer Zaanstreek=Waterland NIET in handen van dit Bedrijf te leggen

Doet u dat wel, dat werkt u mee aan de instandhouding van een

misdadig nederzettingensysteem, aan bezetting en onderdrukking.

EN aan de Misdaad van Apartheid [10]

Dan heeft uw organisatie Bloed aan de Handen en zult u daarop worden

afgerekend.

Binnenkort wordt besloten welk bedrijf het busvervoer in de regio Zaanstreek Waterland mag gaan verzorgen. EBS is één van de bedrijven die meedingen naar deze concessie.

Wat kun je als consument doen om te voorkomen dat jij als OV-reiziger straks moet meebetalen aan mensenrechtenschendingen?

Schrijf een email naar de leden Provinciale Staten van de provincies …. naar de portefeuillehouders OV Gedeputeerde Staten en naar het bedrijf dat belast is met het beoordelen van de inschrijvingen voor de concessie in Zaanstreek Waterland. Laat hen weten dat EBS moet worden uitgesloten van deze concessie en van alle toekomstige concessies, tot het bedrijf zijn leven aantoonbaar heeft gebeterd.”

Er zijn kortom genoeg redenen om EBS uit te sluiten van aanbestedingen in het Nederlandse busvervoer. Bovendien, door concessies aan EBS te gunnen worden reizigers die op het openbaar vervoer zijn aangewezen gedwongen aan boord te gaan bij een bedrijf dat betrokken is bij illegale activiteiten, mensenrechtenschendingen en mogelijke oorlogsmisdaden in bezet Palestina. Reizigers beseffen veelal niet dat hun euro’s indirect ten goede kunnen komen aan mensenrechtenschendingen. Dat zou ook niet hoeven: het publiek moet erop kunnen vertrouwen dat het mensenrechtenbeleid bij de overheid in veilige handen is.

Kom in actie!

Binnenkort wordt besloten welk bedrijf het busvervoer in de regio Zaanstreek Waterland mag gaan verzorgen. EBS is één van de bedrijven die meedingen naar deze concessie.

Wat kun je als consument doen om te voorkomen dat jij als OV-reiziger straks moet meebetalen aan mensenrechtenschendingen?

The bus lines were armored vehicles, that according to the company allowed them to pass through “Arab populated areas”. Since then, the operation of bus lines to settlements was transferred to the company’s subsidiary Egged Taavura. Egged Taavura operates bus lines to settlements in the West Bank, in the areas of Gush Etzion, Giva’at Ze’ev, Binyamin, Mount Hebron and Kiryat Arba, including settlements in the Jordan Valley, and the settlements of Shiloh, Otniel and Ma’ale Adumim.

The company’s subsidiary, Egged Heseim, Tours and Recreation, provides tours and travel packages to the Old City of Jerusalem and the City of David settler complex, located in the Palestinian neighborhood of Silwan in occupied East Jerusalem. The company also organizes tours to Bethlehem, Jericho and the occupied Syrian Golan,

In 2018, the company’s branch in Ashdod organized a donation campaign for the Israeli army in the area surrounding the besieged Gaza.

In November 2014, 27 Palestinian bus drivers at Egged quit their jobs and dozens more went on strike for fear of being attacked by Israeli settlers as tensions increased in Jerusalem during that period. This act came after driver Yusuf Hassan al-Ramouni was found hanged in an Egged bus in Jerusalem.

Presently, the company uses vehicles manufactured by Mercedes and Volvo.

The company is currently running for the tender to operate the new light rail line in Jerusalem, which will connect more settlements. The company was initially disqualified for fear of creating a monopoly (as it also operates buses in Jerusalem), but in March 2019 the general director of the Israeli antitrust authority ruled that it can, provided it commits to dropping some of its bus lines if selected.

UN High Commissioner for Human Rights al-Hussein warns Israeli firms of their inclusion in ‘blacklist’ of companies operating in West Bank, east J’lem, Jordan Valley; list includes prominent companies such as Bezeq, Hot, Ahava, Cellcom, Bank Hapoalim and others; Bezeq CEO scorns ‘entirely anti-Israeli propaganda.’

In the past few weeks, 130 Israeli companies and 60 international corporations operating in Israel received warning letters from United Nations High Commissioner for Human Rights Zeid bin Ra’ad al-Hussein cautioning them of their impending inclusion in a “blacklist” of companies active beyond the Green Line in “violation of international law and UN resolutions.”

 Ynet has gained access to part of the list, which is set to be published in late December and cites 25 well-known Israeli companies. The companies operate in different sectors—some in food manufacturing, others in services, pharmaceuticals and even high-tech—but have one thing in common: they all operate in settlements, east Jerusalem and the Jordan Valley.

Among the companies in the commissioner’s sights are Ahava, Dor Alon,

Amisragas, Angel Bakeries, Arison Investments, Ashdar, Clal Industries, Café Café, Cellcom, Danya Cebus, Electra, HP, Hot, the Israel Aerospace Industries, Matrix Systems, Motorola, Nesher, Partner, Paz, Rami Levy, Remax, Housing & Construction (Shikun Binui), Shufersal, Sonol and Trima.

The above companies are joined by the 12 companies already published on Channel 2 News including Bank Hapoalim, Bank Leumi, Bezeq and Bezeq International, Coca Cola, Africa Israel, Teva, IDB, Egged, Mekorot, Netafim and Elbit Systems.

The “Washington Post” published American companies will also be appearing on the list, including Caterpillar, Tripadvisor and Airbnb.

Some of the companies to be included on the list are still considering their response, but others are already fighting back with the claim their inclusion on the list may cause them financial harm and tarnish their brand, and are therefore looking into filing suits against the Commissioner and the UN’s Human Rights Council that called for the list’s preparation in the first place.

The companies claim the list’s creation was politically motivated and point to the fact that the commissioner constructed no such lists pertaining to other regions of conflict—such as the Crimean Peninsula and Western Sahara—as proof.

Both Israel and the US have been working behind the scenes in the past few weeks to prevent the list’s publication, but it appears it may be presented with a fait accompli. Despite the fact the list carries no operational or legal ramifications, the symbolic move nevertheless caused concern among the Ministry of Foreign Affairs officials due to the fact it may provide a serious boost to BDS efforts, deter foreign investors and convince foreign companies operating in Israel to reduce their operations.

“It may cause large investment firms or pension funds carrying stocks of various Israeli companies to divest in them because they, in turn, operate in the settlements. It may lead to a snowball effect that will greatly harm the Israeli economy eventually,” said a senior Israeli official.

The Ministry of Foreign Affairs estimates the Human Rights Commissioner received most of his information about the Israeli firms from Israeli non-profits operating in the settlements and investigating business activities beyond the Green Line.

AIPAC goes to war

In an effort to scuttle the move, the pro-Israel American Israel Public Affairs Committee (AIPAC) lobby has been working in the US on promoting rapid legislation in Congress determining any company divesting its business dealings from Israel will be considered to have “capitulated” to the Arab boycott, and would thus be in violation of American law.

The Human Rights Council’s efforts to isolate Israel—executed through the office of the commissioner—have largely been facilitated by what Israel frequently slams as the UN body’s years-long anti-Israeli majority which has a long record of a bias slant.

Bezeq CEO Stella Handler published a Facebook post 12 days ago in which she made public the overture she received from the UN’s Human Rights Commissioner. After the Ministry of Foreign Affairs contacted her, Handler took the post down.

“Here’s something the UN’s Human Rights Council doesn’t want you know: we’ve received a message from Special Assistant to UN High Commissioner for Human Rights Mohammad Ali Alnsour. Alnsour communicated to us that Bezeq was to be included on a list of Israeli companies operating in the West Bank. He asked us to keep that information confidential and to not publically comment on it,” Handler’s Facebook post said.


“Before we get started, here’s some background about the UN’s Human Rights Council. Since it was founded in 2006, it published 68 decisions denouncingIsrael, making up 50 percent of the total resolutions pertaining to specific countries the council has made. Not North Korea, not Syria, not Sudan and not Yemen were afforded such attention,” the post continued.

“We will not be cooperating with a move that’s entirely anti-Israeli propaganda. Despite the council’s attempts to harm Israel by harming Bezeq, we give you our solemn commitment to keep focused on what we do best: providing all of Israel’s citizens with quality service, to provide our employees with a fair workplace and to manufacture profits for our shareholders. That is our role as Israel’s communications infrastructures company,” Handler concluded.

In vervolg op ons bericht gisteren over de publicatie door de Verenigde Naties van de lijst met bedrijven die geld verdienen aan de bezetting van Palestijnse gebieden door Israël, hieronder de volledige lijst van 112 bedrijven, overgenomen van middleeasteye. Bij deze lijst moet worden opgemerkt dat hij zeker nog niet compleet is. Een simpel voorbeeld is Albert Hein/de HEMA. Zo zijn er, alleen al in Nederland, meer voorbeelden te noemen. Er is dus nog werk aan de winkel voor de landelijke organisaties, met het oog op de actualisatie van de lijst die volgens de betreffende VN-resolutie elk jaar moet plaatsvinden.

Israeli Government Still Holds Responsibility for Welfare of Civilians

The Israeli government’s plan to remove troops and Jewish settlements from the Gaza Strip would not end Israel’s occupation of the territory. As an occupying power, Israel will retain responsibility for the welfare of Gaza’s civilian population.

Under the “disengagement” plan endorsed Tuesday by the Knesset, Israeli forces will keep control over Gaza’s borders, coastline and airspace, and will reserve the right to launch incursions at will. Israel will continue to wield overwhelming power over the territory’s economy and its access to trade.

“The removal of settlers and most military forces will not end Israel’s control over Gaza,” said Sarah Leah Whitson, Executive Director of Human Rights Watch’s Middle East and North Africa Division. “Israel plans to reconfigure its occupation of the territory, but it will remain an occupying power with responsibility for the welfare of the civilian population.”

Under the plan, Israel is scheduled to remove settlers and military bases protecting the settlers from the Gaza Strip and four isolated West Bank Jewish settlements by the end of 2005. The Israeli military will remain deployed on Gaza’s southern border, and will reposition its forces to other areas just outside the territory.

In addition to controlling the borders, coastline and airspace, Israel will continue to control Gaza’s telecommunications, water, electricity and sewage networks, as well as the flow of people and goods into and out of the territory. Gaza will also continue to use Israeli currency.

A World Bank study on the economic effects of the plan determined that “disengagement” would ease restrictions on mobility inside Gaza. But the study also warned that the removal of troops and settlers would have little positive effect unless accompanied by an opening of Gaza’s borders. If the borders are sealed to labor and trade, the plan “would create worse hardship than is seen today.”

The plan also explicitly envisions continued home demolitions by the Israeli military to expand the “buffer zone” along the Gaza-Egypt border. According to a report released last week by Human Rights Watch, the Israeli military has illegally razed nearly 1,600 homes since 2000 to create this buffer zone, displacing some 16,000 Palestinians. Israeli officials have called for the buffer zone to be doubled, which would result in the destruction of one-third of the Rafah refugee camp.

In addition, the plan states that disengagement “will serve to dispel the claims regarding Israel’s responsibility for the Palestinians in the Gaza Strip.” A report by legal experts from the Israeli Justice Ministry, Foreign Ministry and the military made public on Sunday, however, reportedly acknowledges that disengagement “does not necessarily exempt Israel from responsibility in the evacuated territories.”

If Israel removes its troops from Gaza, the Palestinian National Authority will maintain responsibility for security within the territory—to the extent that Israel allows Palestinian police the authority and capacity. Palestinian security forces will still have a duty to protect civilians within Gaza and to prevent indiscriminate attacks on Israeli civilians.

“Under international law, the test for determining whether an occupation exists is effective control by a hostile army, not the positioning of troops,” Whitson said. “Whether the Israeli army is inside Gaza or redeployed around its periphery and restricting entrance and exit, it remains in control.”

Under international law, the duties of an occupying power are detailed in the Fourth Geneva Convention and The Hague Regulations. According to The Hague Regulations, a “territory is considered occupied when it is actually placed under the authority of the hostile army. The occupation extends only to the territory where such authority has been established and can be exercised.”

Hierbij een dringend beroep op u NIET met dit door en door foute

bedrijf in zee te gaan!

WAAROM FOUT BEDRIJF?

Dit bedrijf, EBS, is dochter van het Israelische Bedrijf Egged Group,

dat betrokken is bij de illegale Israelische nederzettingen! [2],

waardoor dit bedrijf op de VN Zwarte Lijst is komen te staan.

Ik ga ervan uit, u niet meer te hoeven in te lichten over de foute, illegale

Israelische bezetting van de Palestijnse gebieden de Westelijke Jordaanoever,

Oost-Jeruzalem en Gaza [4] en de daaraan gekoppelde onderdrukking en 

gepleegde oorlogsmisdaden, met name tijdens de invallen in Gaza [5].

Maar er is, zoals u behoort te weten [want daar gaat deze Brief over] meer.

Want niet alleen oefent Israel een bezettingsterreur uit en wordt

door de mensenrechtenorganisaties Amnesty International en Human

Rights Watch terecht beschouwd als een Apartheidsstaat [6], Israel houdt

zich ook onledig met een ander Groot Kwaad:

De in bezet gebied gebouwde en zich immer uitbreidende nederzettingen,

wat neerkomt op platte landroof en die illegaal zijn volgens het

Internationaal Recht! [7]

Dat weet u of althans:

Dat hoort u te weten.

Dan heb ik het nog niet eens gehad over de dagelijkse terreur,

die door de kolonisten [bewoners van die nederzettingen] wordt uitgeoefend

tegen de bezette Palestijnse bevolking, een terreur, die zijn steun vindt

in de Israelische Bezettingsstaat! [8]

Ik denk het niet

Ik heb u de feiten gegeven

Zowel over de misdaden van Bezettingsstaat Israel als 

het feit, dat dit specifieke Bedrijf werkzaam is in

de illegale nederzettingen, ontstaan door geweld tegen en

landroof op de bezette Palestijnse bevolking, een Bedrijf dat,

zoals ik in bovenstaande genoemd heb, bovendien op

de VN Zwarte Lijst staat. [9]

Feitelijk is het al een schande voor u, dat ik [en vele anderen, naar ik hoop]

u deze informatie moesten aandragen

Uit uzelf had u al op de hoogte moeten zijn en niet eens de samenwerking

met een dergelijk Gangsterbedrijf moeten overwegen!

Maar nu kent u de feiten en kunt u er NIET meer omheen!

Een dringende oproep dus om de verzorging van het OV vervoer Zaanstreek=Waterland NIET in handen van dit Bedrijf te leggen

Doet u dat wel, dat werkt u mee aan de instandhouding van een

misdadig nederzettingensysteem, aan bezetting en onderdrukking.

Wat kun je als consument doen om te voorkomen dat jij als OV-reiziger straks moet meebetalen aan mensenrechtenschendingen?

Schrijf een email naar de leden Provinciale Staten van de provincies …. naar de portefeuillehouders OV Gedeputeerde Staten en naar het bedrijf dat belast is met het beoordelen van de inschrijvingen voor de concessie in Zaanstreek Waterland. Laat hen weten dat EBS moet worden uitgesloten van deze concessie en van alle toekomstige concessies, tot het bedrijf zijn leven aantoonbaar heeft gebeterd.”

EBS BUSSEN: ONBEWUST MEELIFTEN MET APARTHEID

Er zijn kortom genoeg redenen om EBS uit te sluiten van aanbestedingen in het Nederlandse busvervoer. Bovendien, door concessies aan EBS te gunnen worden reizigers die op het openbaar vervoer zijn aangewezen gedwongen aan boord te gaan bij een bedrijf dat betrokken is bij illegale activiteiten, mensenrechtenschendingen en mogelijke oorlogsmisdaden in bezet Palestina. Reizigers beseffen veelal niet dat hun euro’s indirect ten goede kunnen komen aan mensenrechtenschendingen. Dat zou ook niet hoeven: het publiek moet erop kunnen vertrouwen dat het mensenrechtenbeleid bij de overheid in veilige handen is.

Kom in actie!

In 2018, the company’s branch in Ashdod organized a donation campaign for the Israeli army in the area surrounding the besieged Gaza.

In November 2014, 27 Palestinian bus drivers at Egged quit their jobs and dozens more went on strike for fear of being attacked by Israeli settlers as tensions increased in Jerusalem during that period. This act came after driver Yusuf Hassan al-Ramouni was found hanged in an Egged bus in Jerusalem.

Presently, the company uses vehicles manufactured by Mercedes and Volvo.

The company is currently running for the tender to operate the new light rail line in Jerusalem, which will connect more settlements. The company was initially disqualified for fear of creating a monopoly (as it also operates buses in Jerusalem), but in March 2019 the general director of the Israeli antitrust authority ruled that it can, provided it commits to dropping some of its bus lines if selected.

UN High Commissioner for Human Rights al-Hussein warns Israeli firms of their inclusion in ‘blacklist’ of companies operating in West Bank, east J’lem, Jordan Valley; list includes prominent companies such as Bezeq, Hot, Ahava, Cellcom, Bank Hapoalim and others; Bezeq CEO scorns ‘entirely anti-Israeli propaganda.’

In the past few weeks, 130 Israeli companies and 60 international corporations operating in Israel received warning letters from United Nations High Commissioner for Human Rights Zeid bin Ra’ad al-Hussein cautioning them of their impending inclusion in a “blacklist” of companies active beyond the Green Line in “violation of international law and UN resolutions.”

 Ynet has gained access to part of the list, which is set to be published in late December and cites 25 well-known Israeli companies. The companies operate in different sectors—some in food manufacturing, others in services, pharmaceuticals and even high-tech—but have one thing in common: they all operate in settlements, east Jerusalem and the Jordan Valley.

Among the companies in the commissioner’s sights are Ahava, Dor Alon,

Amisragas, Angel Bakeries, Arison Investments, Ashdar, Clal Industries, Café Café, Cellcom, Danya Cebus, Electra, HP, Hot, the Israel Aerospace Industries, Matrix Systems, Motorola, Nesher, Partner, Paz, Rami Levy, Remax, Housing & Construction (Shikun Binui), Shufersal, Sonol and Trima.

The above companies are joined by the 12 companies already published on Channel 2 News including Bank Hapoalim, Bank Leumi, Bezeq and Bezeq International, Coca Cola, Africa Israel, Teva, IDB, Egged, Mekorot, Netafim and Elbit Systems.

The “Washington Post” published American companies will also be appearing on the list, including Caterpillar, Tripadvisor and Airbnb.

Some of the companies to be included on the list are still considering their response, but others are already fighting back with the claim their inclusion on the list may cause them financial harm and tarnish their brand, and are therefore looking into filing suits against the Commissioner and the UN’s Human Rights Council that called for the list’s preparation in the first place.

The companies claim the list’s creation was politically motivated and point to the fact that the commissioner constructed no such lists pertaining to other regions of conflict—such as the Crimean Peninsula and Western Sahara—as proof.

Both Israel and the US have been working behind the scenes in the past few weeks to prevent the list’s publication, but it appears it may be presented with a fait accompli. Despite the fact the list carries no operational or legal ramifications, the symbolic move nevertheless caused concern among the Ministry of Foreign Affairs officials due to the fact it may provide a serious boost to BDS efforts, deter foreign investors and convince foreign companies operating in Israel to reduce their operations.

“It may cause large investment firms or pension funds carrying stocks of various Israeli companies to divest in them because they, in turn, operate in the settlements. It may lead to a snowball effect that will greatly harm the Israeli economy eventually,” said a senior Israeli official.

The Ministry of Foreign Affairs estimates the Human Rights Commissioner received most of his information about the Israeli firms from Israeli non-profits operating in the settlements and investigating business activities beyond the Green Line.

AIPAC goes to war

In an effort to scuttle the move, the pro-Israel American Israel Public Affairs Committee (AIPAC) lobby has been working in the US on promoting rapid legislation in Congress determining any company divesting its business dealings from Israel will be considered to have “capitulated” to the Arab boycott, and would thus be in violation of American law.

The Human Rights Council’s efforts to isolate Israel—executed through the office of the commissioner—have largely been facilitated by what Israel frequently slams as the UN body’s years-long anti-Israeli majority which has a long record of a bias slant.

Bezeq CEO Stella Handler published a Facebook post 12 days ago in which she made public the overture she received from the UN’s Human Rights Commissioner. After the Ministry of Foreign Affairs contacted her, Handler took the post down.

“Here’s something the UN’s Human Rights Council doesn’t want you know: we’ve received a message from Special Assistant to UN High Commissioner for Human Rights Mohammad Ali Alnsour. Alnsour communicated to us that Bezeq was to be included on a list of Israeli companies operating in the West Bank. He asked us to keep that information confidential and to not publically comment on it,” Handler’s Facebook post said.


“Before we get started, here’s some background about the UN’s Human Rights Council. Since it was founded in 2006, it published 68 decisions denouncingIsrael, making up 50 percent of the total resolutions pertaining to specific countries the council has made. Not North Korea, not Syria, not Sudan and not Yemen were afforded such attention,” the post continued.

“We will not be cooperating with a move that’s entirely anti-Israeli propaganda. Despite the council’s attempts to harm Israel by harming Bezeq, we give you our solemn commitment to keep focused on what we do best: providing all of Israel’s citizens with quality service, to provide our employees with a fair workplace and to manufacture profits for our shareholders. That is our role as Israel’s communications infrastructures company,” Handler concluded.

In vervolg op ons bericht gisteren over de publicatie door de Verenigde Naties van de lijst met bedrijven die geld verdienen aan de bezetting van Palestijnse gebieden door Israël, hieronder de volledige lijst van 112 bedrijven, overgenomen van middleeasteye. Bij deze lijst moet worden opgemerkt dat hij zeker nog niet compleet is. Een simpel voorbeeld is Albert Hein/de HEMA. Zo zijn er, alleen al in Nederland, meer voorbeelden te noemen. Er is dus nog werk aan de winkel voor de landelijke organisaties, met het oog op de actualisatie van de lijst die volgens de betreffende VN-resolutie elk jaar moet plaatsvinden.

Israeli Government Still Holds Responsibility for Welfare of Civilians

The Israeli government’s plan to remove troops and Jewish settlements from the Gaza Strip would not end Israel’s occupation of the territory. As an occupying power, Israel will retain responsibility for the welfare of Gaza’s civilian population.

Under the “disengagement” plan endorsed Tuesday by the Knesset, Israeli forces will keep control over Gaza’s borders, coastline and airspace, and will reserve the right to launch incursions at will. Israel will continue to wield overwhelming power over the territory’s economy and its access to trade.

“The removal of settlers and most military forces will not end Israel’s control over Gaza,” said Sarah Leah Whitson, Executive Director of Human Rights Watch’s Middle East and North Africa Division. “Israel plans to reconfigure its occupation of the territory, but it will remain an occupying power with responsibility for the welfare of the civilian population.”

Under the plan, Israel is scheduled to remove settlers and military bases protecting the settlers from the Gaza Strip and four isolated West Bank Jewish settlements by the end of 2005. The Israeli military will remain deployed on Gaza’s southern border, and will reposition its forces to other areas just outside the territory.

In addition to controlling the borders, coastline and airspace, Israel will continue to control Gaza’s telecommunications, water, electricity and sewage networks, as well as the flow of people and goods into and out of the territory. Gaza will also continue to use Israeli currency.

A World Bank study on the economic effects of the plan determined that “disengagement” would ease restrictions on mobility inside Gaza. But the study also warned that the removal of troops and settlers would have little positive effect unless accompanied by an opening of Gaza’s borders. If the borders are sealed to labor and trade, the plan “would create worse hardship than is seen today.”

The plan also explicitly envisions continued home demolitions by the Israeli military to expand the “buffer zone” along the Gaza-Egypt border. According to a report released last week by Human Rights Watch, the Israeli military has illegally razed nearly 1,600 homes since 2000 to create this buffer zone, displacing some 16,000 Palestinians. Israeli officials have called for the buffer zone to be doubled, which would result in the destruction of one-third of the Rafah refugee camp.

In addition, the plan states that disengagement “will serve to dispel the claims regarding Israel’s responsibility for the Palestinians in the Gaza Strip.” A report by legal experts from the Israeli Justice Ministry, Foreign Ministry and the military made public on Sunday, however, reportedly acknowledges that disengagement “does not necessarily exempt Israel from responsibility in the evacuated territories.”

If Israel removes its troops from Gaza, the Palestinian National Authority will maintain responsibility for security within the territory—to the extent that Israel allows Palestinian police the authority and capacity. Palestinian security forces will still have a duty to protect civilians within Gaza and to prevent indiscriminate attacks on Israeli civilians.

“Under international law, the test for determining whether an occupation exists is effective control by a hostile army, not the positioning of troops,” Whitson said. “Whether the Israeli army is inside Gaza or redeployed around its periphery and restricting entrance and exit, it remains in control.”

Under international law, the duties of an occupying power are detailed in the Fourth Geneva Convention and The Hague Regulations. According to The Hague Regulations, a “territory is considered occupied when it is actually placed under the authority of the hostile army. The occupation extends only to the territory where such authority has been established and can be exercised.”

BEZETTING EN NEDERZETTINGEN

Ik ga ervan uit, u niet meer te hoeven in te lichten over de foute, illegale

Israelische bezetting van de Palestijnse gebieden de Westelijke Jordaanoever,

Oost-Jeruzalem en Gaza [4] en de daaraan gekoppelde onderdrukking en 

gepleegde oorlogsmisdaden, met name tijdens de invallen in Gaza [5].

Maar er is, zoals u behoort te weten [want daar gaat deze Brief over] meer.

Want niet alleen oefent Israel een bezettingsterreur uit en wordt

door de mensenrechtenorganisaties Amnesty International en Human

Rights Watch terecht beschouwd als een Apartheidsstaat [6], Israel houdt

zich ook onledig met een ander Groot Kwaad:

De in bezet gebied gebouwde en zich immer uitbreidende nederzettingen,

wat neerkomt op platte landroof en die illegaal zijn volgens het

Internationaal Recht! [7]

Dat weet u of althans:

Dat hoort u te weten.

Dan heb ik het nog niet eens gehad over de dagelijkse terreur,

die door de kolonisten [bewoners van die nederzettingen] wordt uitgeoefend

tegen de bezette Palestijnse bevolking, een terreur, die zijn steun vindt

Ik heb u de feiten gegeven

Zowel over de misdaden van Bezettingsstaat Israel als 

het feit, dat dit specifieke Bedrijf werkzaam is in

de illegale nederzettingen, ontstaan door geweld tegen en

landroof op de bezette Palestijnse bevolking, een Bedrijf dat,

zoals ik in bovenstaande genoemd heb, bovendien op

de VN Zwarte Lijst staat. [9]

Feitelijk is het al een schande voor u, dat ik [en vele anderen, naar ik hoop]

u deze informatie moesten aandragen

Uit uzelf had u al op de hoogte moeten zijn en niet eens de samenwerking

met een dergelijk Gangsterbedrijf moeten overwegen!

Maar nu kent u de feiten en kunt u er NIET meer omheen!

Een dringende oproep dus om de verzorging van het OV vervoer Zaanstreek=Waterland NIET in handen van dit Bedrijf te leggen

Er zijn kortom genoeg redenen om EBS uit te sluiten van aanbestedingen in het Nederlandse busvervoer. Bovendien, door concessies aan EBS te gunnen worden reizigers die op het openbaar vervoer zijn aangewezen gedwongen aan boord te gaan bij een bedrijf dat betrokken is bij illegale activiteiten, mensenrechtenschendingen en mogelijke oorlogsmisdaden in bezet Palestina. Reizigers beseffen veelal niet dat hun euro’s indirect ten goede kunnen komen aan mensenrechtenschendingen. Dat zou ook niet hoeven: het publiek moet erop kunnen vertrouwen dat het mensenrechtenbeleid bij de overheid in veilige handen is.

The bus lines were armored vehicles, that according to the company allowed them to pass through “Arab populated areas”. Since then, the operation of bus lines to settlements was transferred to the company’s subsidiary Egged Taavura. In 2018, the company’s branch in Ashdod organized a donation campaign for the Israeli army in the area surrounding the besieged Gaza.

In November 2014, 27 Palestinian bus drivers at Egged quit their jobs and dozens more went on strike for fear of being attacked by Israeli settlers as tensions increased in Jerusalem during that period. This act came after driver Yusuf Hassan al-Ramouni was found hanged in an Egged bus in Jerusalem.

Presently, the company uses vehicles manufactured by Mercedes and Volvo.

The company is currently running for the tender to operate the new light rail line in Jerusalem, which will connect more settlements. The company was initially disqualified for fear of creating a monopoly (as it also operates buses in Jerusalem), but in March 2019 the general director of the Israeli antitrust authority ruled that it can, provided it commits to dropping some of its bus lines if selected.

UN High Commissioner for Human Rights al-Hussein warns Israeli firms of their inclusion in ‘blacklist’ of companies operating in West Bank, east J’lem, Jordan Valley; list includes prominent companies such as Bezeq, Hot, Ahava, Cellcom, Bank Hapoalim and others; Bezeq CEO scorns ‘entirely anti-Israeli propaganda.’

In the past few weeks, 130 Israeli companies and 60 international corporations operating in Israel received warning letters from United Nations High Commissioner for Human Rights Zeid bin Ra’ad al-Hussein cautioning them of their impending inclusion in a “blacklist” of companies active beyond the Green Line in “violation of international law and UN resolutions.”

 Ynet has gained access to part of the list, which is set to be published in late December and cites 25 well-known Israeli companies. The companies operate in different sectors—some in food manufacturing, others in services, pharmaceuticals and even high-tech—but have one thing in common: they all operate in settlements, east Jerusalem and the Jordan Valley.

Among the companies in the commissioner’s sights are Ahava, Dor Alon,

Amisragas, Angel Bakeries, Arison Investments, Ashdar, Clal Industries, Café Café, Cellcom, Danya Cebus, Electra, HP, Hot, the Israel Aerospace Industries, Matrix Systems, Motorola, Nesher, Partner, Paz, Rami Levy, Remax, Housing & Construction (Shikun Binui), Shufersal, Sonol and Trima.

The above companies are joined by the 12 companies already published on Channel 2 News including Bank Hapoalim, Bank Leumi, Bezeq and Bezeq International, Coca Cola, Africa Israel, Teva, IDB, Egged, Mekorot, Netafim and Elbit Systems.

The “Washington Post” published American companies will also be appearing on the list, including Caterpillar, Tripadvisor and Airbnb.

Some of the companies to be included on the list are still considering their response, but others are already fighting back with the claim their inclusion on the list may cause them financial harm and tarnish their brand, and are therefore looking into filing suits against the Commissioner and the UN’s Human Rights Council that called for the list’s preparation in the first place.

The companies claim the list’s creation was politically motivated and point to the fact that the commissioner constructed no such lists pertaining to other regions of conflict—such as the Crimean Peninsula and Western Sahara—as proof.

Both Israel and the US have been working behind the scenes in the past few weeks to prevent the list’s publication, but it appears it may be presented with a fait accompli. Despite the fact the list carries no operational or legal ramifications, the symbolic move nevertheless caused concern among the Ministry of Foreign Affairs officials due to the fact it may provide a serious boost to BDS efforts, deter foreign investors and convince foreign companies operating in Israel to reduce their operations.

“It may cause large investment firms or pension funds carrying stocks of various Israeli companies to divest in them because they, in turn, operate in the settlements. It may lead to a snowball effect that will greatly harm the Israeli economy eventually,” said a senior Israeli official.

The Ministry of Foreign Affairs estimates the Human Rights Commissioner received most of his information about the Israeli firms from Israeli non-profits operating in the settlements and investigating business activities beyond the Green Line.

AIPAC goes to war

In an effort to scuttle the move, the pro-Israel American Israel Public Affairs Committee (AIPAC) lobby has been working in the US on promoting rapid legislation in Congress determining any company divesting its business dealings from Israel will be considered to have “capitulated” to the Arab boycott, and would thus be in violation of American law.

The Human Rights Council’s efforts to isolate Israel—executed through the office of the commissioner—have largely been facilitated by what Israel frequently slams as the UN body’s years-long anti-Israeli majority which has a long record of a bias slant.

Bezeq CEO Stella Handler published a Facebook post 12 days ago in which she made public the overture she received from the UN’s Human Rights Commissioner. After the Ministry of Foreign Affairs contacted her, Handler took the post down.

“Here’s something the UN’s Human Rights Council doesn’t want you know: we’ve received a message from Special Assistant to UN High Commissioner for Human Rights Mohammad Ali Alnsour. Alnsour communicated to us that Bezeq was to be included on a list of Israeli companies operating in the West Bank. He asked us to keep that information confidential and to not publically comment on it,” Handler’s Facebook post said.


“Before we get started, here’s some background about the UN’s Human Rights Council. Since it was founded in 2006, it published 68 decisions denouncingIsrael, making up 50 percent of the total resolutions pertaining to specific countries the council has made. Not North Korea, not Syria, not Sudan and not Yemen were afforded such attention,” the post continued.

“We will not be cooperating with a move that’s entirely anti-Israeli propaganda. Despite the council’s attempts to harm Israel by harming Bezeq, we give you our solemn commitment to keep focused on what we do best: providing all of Israel’s citizens with quality service, to provide our employees with a fair workplace and to manufacture profits for our shareholders. That is our role as Israel’s communications infrastructures company,” Handler concluded.

In vervolg op ons bericht gisteren over de publicatie door de Verenigde Naties van de lijst met bedrijven die geld verdienen aan de bezetting van Palestijnse gebieden door Israël, hieronder de volledige lijst van 112 bedrijven, overgenomen van middleeasteye. Bij deze lijst moet worden opgemerkt dat hij zeker nog niet compleet is. Een simpel voorbeeld is Albert Hein/de HEMA. Zo zijn er, alleen al in Nederland, meer voorbeelden te noemen. Er is dus nog werk aan de winkel voor de landelijke organisaties, met het oog op de actualisatie van de lijst die volgens de betreffende VN-resolutie elk jaar moet plaatsvinden.

The Israeli government’s plan to remove troops and Jewish settlements from the Gaza Strip would not end Israel’s occupation of the territory. As an occupying power, Israel will retain responsibility for the welfare of Gaza’s civilian population.

Under the “disengagement” plan endorsed Tuesday by the Knesset, Israeli forces will keep control over Gaza’s borders, coastline and airspace, and will reserve the right to launch incursions at will. Israel will continue to wield overwhelming power over the territory’s economy and its access to trade.

“The removal of settlers and most military forces will not end Israel’s control over Gaza,” said Sarah Leah Whitson, Executive Director of Human Rights Watch’s Middle East and North Africa Division. “Israel plans to reconfigure its occupation of the territory, but it will remain an occupying power with responsibility for the welfare of the civilian population.”

Under the plan, Israel is scheduled to remove settlers and military bases protecting the settlers from the Gaza Strip and four isolated West Bank Jewish settlements by the end of 2005. The Israeli military will remain deployed on Gaza’s southern border, and will reposition its forces to other areas just outside the territory.

In addition to controlling the borders, coastline and airspace, Israel will continue to control Gaza’s telecommunications, water, electricity and sewage networks, as well as the flow of people and goods into and out of the territory. Gaza will also continue to use Israeli currency.

A World Bank study on the economic effects of the plan determined that “disengagement” would ease restrictions on mobility inside Gaza. But the study also warned that the removal of troops and settlers would have little positive effect unless accompanied by an opening of Gaza’s borders. If the borders are sealed to labor and trade, the plan “would create worse hardship than is seen today.”

The plan also explicitly envisions continued home demolitions by the Israeli military to expand the “buffer zone” along the Gaza-Egypt border. According to a report released last week by Human Rights Watch, the Israeli military has illegally razed nearly 1,600 homes since 2000 to create this buffer zone, displacing some 16,000 Palestinians. Israeli officials have called for the buffer zone to be doubled, which would result in the destruction of one-third of the Rafah refugee camp.

In addition, the plan states that disengagement “will serve to dispel the claims regarding Israel’s responsibility for the Palestinians in the Gaza Strip.” A report by legal experts from the Israeli Justice Ministry, Foreign Ministry and the military made public on Sunday, however, reportedly acknowledges that disengagement “does not necessarily exempt Israel from responsibility in the evacuated territories.”

If Israel removes its troops from Gaza, the Palestinian National Authority will maintain responsibility for security within the territory—to the extent that Israel allows Palestinian police the authority and capacity. Palestinian security forces will still have a duty to protect civilians within Gaza and to prevent indiscriminate attacks on Israeli civilians.

“Under international law, the test for determining whether an occupation exists is effective control by a hostile army, not the positioning of troops,” Whitson said. “Whether the Israeli army is inside Gaza or redeployed around its periphery and restricting entrance and exit, it remains in control.”

Under international law, the duties of an occupying power are detailed in the Fourth Geneva Convention and The Hague Regulations. According to The Hague Regulations, a “territory is considered occupied when it is actually placed under the authority of the hostile army. The occupation extends only to the territory where such authority has been established and can be exercised.”

Lezers, het is bekend, dat ik twee brieven heb geschreven aan

Metropoolregio Rotterdam Den Haag,

vanwege het feit, dat zij in zee wilden gaan
[en in het verleden al gedaan hebben] met Busbedrijf EBS, dochteronderneming
van het Israelische Busbedrijf Egged Group, dat is verweven met de
illegale Israelische nederzettingen.
 
Natuurlijk was mijn eis, dat zij NIET met dit bedrijf in zee gingen!
